SMS Messaging Terms & Conditions

Welcome to the NoraCare SMS Messaging Program (“Program”). These Terms & Conditions (“Terms”) describe how NoraCare uses SMS text messaging to communicate with clients, caregivers, and families.

By enrolling in this Program, you agree to the following terms in addition to our website’s general Privacy Policy and Terms of Use.

1. Purpose and Program Overview

NoraCare’s SMS Messaging Program is designed to keep clients and caregivers informed through convenient, timely, and reliable text updates. These messages may include, but are not limited to:

  • Caregiver scheduling notifications and confirmations
  • Appointment reminders and service updates
  • Wellness and health education resources
  • Community activity invitations and announcements
  • Client and family engagement messages
  • Organizational alerts, policy updates, and compliance notices

Message Frequency:

Participants may receive up to five (5) text messages per month. Actual frequency may vary depending on the recipient’s engagement level, service type, or specific program participation.

2. How Consent Is Collected

When you opt into the Program—whether through our website, paper forms, verbal consent recorded by staff, or an online checkbox—you:

  1. Provide express written consent to receive recurring automated and non-automated SMS text messages from NoraCare at the phone number you provide.
  2. Acknowledge that consent is not a condition of receiving services or care.
  3. Confirm that you are the account holder or have permission from the account holder for the provided number.
  4. Understand that message and data rates may apply, depending on your mobile carrier plan.

3. Cost and Billing

  • NoraCare provides this Program at no cost.
  • Standard message and data rates may apply through your wireless carrier.
  • All such charges are the responsibility of the subscriber and are billed directly by the carrier, not NoraCare.

4. How to Opt Out (STOP)

You can cancel text communications from NoraCare at any time.

  • Reply “STOP” to any SMS you receive from us.
  • You will receive one final text confirming your opt-out request.
  • After confirmation, you will no longer receive SMS messages from NoraCare unless you re-enroll.

There is no fee to opt out.

  • Delivery of messages is subject to your carrier’s network availability.
  • Carriers are not liable for delayed, undelivered, or misdirected messages.
  • Service availability may vary by location and device.

7. Privacy and Data Protection

Protecting your personal information is central to our mission of trust and care.

  • NoraCare will not share, sell, rent, or transfer your mobile number or SMS opt-in data to third parties or affiliates for marketing or solicitation purposes.
  • Your phone number will be used solely to deliver communications related to NoraCare’s services, care coordination, and engagement programs.
  • Information collected through the SMS Program is governed by NoraCare’s Privacy Policy.

“NoraCare does not share mobile opt-in data with third parties or affiliates.”

8. Participant Responsibilities

  • You are at least 18 years of age, or have parental/guardian consent if under 18.
  • The mobile number you provide is accurate and under your control.
  • You will notify NoraCare if your number changes, is reassigned, or becomes inactive.
  • You understand that text messages are not guaranteed to be confidential once received on your device.

9. Security of Information

NoraCare uses appropriate administrative, technical, and physical safeguards to protect your information. However, text messaging is not a fully secure form of communication.

By opting in, you acknowledge that:

  • SMS messages may be accessible to your mobile carrier, phone manufacturer, or anyone with access to your device.
  • You accept these inherent security limitations of text communication.

10. Disclaimer of Warranties

The SMS Program is provided on an “as is” and “as available” basis.

  • Messages may not always be delivered without delay or error.
  • Message content may contain inaccuracies or omissions.
  • The Program may experience interruption or technical failure.

11. Limitation of Liability

To the fullest extent permitted by law:

  • NoraCare, its affiliates, and employees are not liable for damages arising from participation in the SMS Program.
  • Neither NoraCare nor mobile carriers are responsible for delayed, undelivered, or misrouted messages.

12. Modification or Termination of the Program

NoraCare reserves the right to modify, suspend, or terminate this SMS Program at any time, with or without notice. Any updates will be posted on this page.
